Digital Millennium Copyright Act Policy

The Fake Food Show respects intellectual property rights and takes copyright seriously. We comply with the Digital Millennium Copyright Act, codified at 17 U.S.C. Section 512, and we will respond promptly to valid copyright infringement notices submitted to our designated agent.

How to Submit a Copyright Infringement Notice

If you believe that content published on thefakefoodshow.com infringes a copyright you own or control, please send a written notice to our designated DMCA agent at:

Your notice must include all of the following to be considered valid:

  1. A description of the copyrighted work you believe has been infringed. If multiple works are covered by a single notice, you may provide a representative list.
  2. A specific description of the material you believe is infringing, with enough detail for us to locate it. This should include the full URL of the page where the material appears.
  3. Your contact information, including your full name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that use of the material in the manner described is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature.

Notices that are incomplete or do not include all required elements cannot be processed. Please review this list carefully before submitting.

What Happens After We Receive Your Notice

Once we receive a complete and valid DMCA notice, we will take the following steps:

  • Remove or disable access to the allegedly infringing content as promptly as reasonably possible.
  • Make a reasonable effort to notify the person who posted the content.
  • Keep a record of the notice in accordance with applicable law.

In appropriate cases, we will terminate the access of users who are found to be repeat infringers.

Counter-Notification Procedure

If you believe that content you posted was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. A description of the content that was removed and the URL where it appeared before removal.
  3. Your name, mailing address, telephone number, and email address.
  4. A statement under penalty of perjury that you believe in good faith that the content was removed or disabled as a result of a mistake or misidentification.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if you reside outside the United States, any judicial district in which The Fake Food Show may be found. You must also agree to accept service of process from the person who originally submitted the infringement notice.

If we receive a valid counter-notification, we may restore the removed content within 10 to 14 business days, unless the original complaining party notifies us that they have filed a court action against you.

Misrepresentation Warning

Be aware that under 17 U.S.C. Section 512(f), any person who knowingly and materially misrepresents that content is infringing, or that content was removed by mistake, may be held liable for damages, costs, and attorney fees.
